1. Introduction and Acceptance

These Terms & Conditions ("Terms") govern your access to and use of the BrainCura website, mobile application, and related services (collectively, the "Platform"), operated by BrainCura Ltd, registered at Spectrum House, 2B Suttons Lane, Hornchurch, Essex, RM12 6RJ, England, United Kingdom ("BrainCura," "we," "us," or "our"). By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform.

2. Definitions

"User," "you," or "your" refers to any individual who accesses or uses the Platform. "Therapist" refers to independent, licensed mental-health professionals available through the Platform. "Content" refers to all materials made available on the Platform. "Subscription" refers to any paid plan offered by BrainCura.

3. Services Provided

BrainCura provides mental-wellness assessments, therapist matching services, AI-assisted mental-wellness support, personalized sound-therapy sessions, mood and wellness tracking, educational and self-help content, and subscription-based premium features. BrainCura is intended for wellness support only and is not a substitute for emergency medical or psychiatric treatment, diagnosis, or care.

4. Eligibility

You must be at least 18 years old to create an account and use the Platform. Individuals under 18 may use the services only with the verifiable consent and supervision of a parent or legal guardian, where permitted by applicable law. You agree to provide accurate, current, and complete registration information and to keep it updated. BrainCura may verify eligibility and refuse or terminate access where requirements are not met.

5. User Accounts

You are responsible for maintaining the confidentiality of your account, protecting your login credentials, and all activity occurring under your account. You agree to notify us immediately of any unauthorized use or security breach. BrainCura reserves the right to suspend or terminate accounts that violate these Terms.

6. Therapist Services Disclaimer

Therapists available on the Platform are independent professionals, not employees or agents of BrainCura. BrainCura only facilitates connections between users and therapists and does not provide therapy directly. The therapeutic relationship exists solely between you and the therapist. Treatment outcomes cannot be guaranteed, and you should independently evaluate all healthcare decisions.

7. AI Support Disclaimer

BrainCura's AI tools provide informational and wellness guidance only. They do not diagnose medical or mental-health conditions, do not prescribe treatment, do not replace licensed healthcare professionals, and should never be relied upon during emergencies. AI-generated responses may occasionally be inaccurate or incomplete.

8. Emergency Situations

BrainCura is not an emergency service. 9. Subscriptions, Billing, and Payments

Certain features require a paid Subscription. Premium plans may include therapy sessions, personalized wellness plans, advanced mood tracking, and sound-therapy programs. Fees are charged according to the plan you select, and applicable taxes may apply depending on your jurisdiction. Subscriptions renew automatically at the end of each billing cycle unless canceled beforehand. Pricing may change with prior notice, and continued use after a price change constitutes acceptance of the updated fees.

10. Cancellation

You may cancel your Subscription at any time through account settings or by contacting support at info@braincura.com. Cancellation takes effect at the end of the current billing period, and you will retain access to premium features until then. You must cancel at least 24 hours before the renewal date.

11. Refund Policy

Refunds are granted only in accordance with BrainCura's Refund Policy. Completed sessions are non-refundable, and partially used Subscriptions may not qualify for refunds. Special cases are reviewed individually at BrainCura's discretion and in accordance with applicable consumer-protection laws.

12. Privacy and Data Protection

By using the Platform, you consent to the collection and processing of your information, including registration details, wellness assessments, mood-tracking data, therapy session records, and usage analytics, as described in our Privacy Policy. BrainCura implements reasonable technical and organizational security measures to protect your data, though no online system can guarantee absolute security.

13. User Conduct and Prohibited Activities

You agree not to share false or misleading information; harass, abuse, or threaten therapists, staff, or other users; attempt unauthorized access to the Platform or other accounts; upload malicious or harmful software; use the services for any unlawful purpose; or copy, resell, or redistribute Platform content. Violation may result in suspension or termination.

14. Intellectual Property

All Content on the Platform — including branding, logos, software, audio frequencies, wellness programs, articles, and educational materials — remains the exclusive property of BrainCura or its licensors. You may not copy, modify, distribute, reproduce, sell, or reverse-engineer any Content without prior written permission. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes.

15. Third-Party Services

The Platform may integrate or link to third-party services such as payment processors, video-conferencing tools, cloud hosting, and analytics providers. BrainCura is not responsible for the content, policies, or practices of these third parties, and you should review their terms independently.

16. Limitation of Liability

To the maximum extent permitted by law, BrainCura shall not be liable for any indirect, incidental, or consequential damages, including loss of data, business interruption, therapist-client disputes, or decisions made based on Platform content. The services are provided on an "as is" and "as available" basis without warranties of any kind. Our liability is limited to the amount you paid to BrainCura in the preceding 12 months, subject to local law.

17. Indemnification

You agree to indemnify and hold harmless BrainCura, its affiliates, and their respective staff from any claims, damages, or expenses arising from your misuse of the Platform or violation of these Terms.

18. Termination

BrainCura may suspend or terminate your account for violations of these Terms, fraudulent activity, abuse of services, or security concerns. You may stop using the Platform at any time. Provisions relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

19. Changes to These Terms

BrainCura may update these Terms from time to time. Material changes will be communicated by posting the updated version with a revised "Last Updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

20. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England, United Kingdom, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in England, United Kingdom, or resolved through binding arbitration.

21. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
